PRIVACY POLICY

This Privacy Policy constitutes a legal agreement between you and LogicielRoadTripMoustache Inc. (hereinafter “LogicielRoadTripMoustache”) concerning the use of its Nestor Guide application (hereinafter the “Service”).

By using the Service, you declare that you have read this privacy policy, acknowledge that you have understood its scope, and consent to its application in a free and informed manner.

You understand that by communicating your personal information(s) to LogicielRoadTripMoustache, you consent to LogicielRoadTripMoustache collecting, using, and processing it for the reasons and in the manner provided for in this privacy policy.

You expressly represent and warrant that you have the legal right and capacity to give this consent. Failing this, we invite you not to use the Service or to discontinue using it.

LogicielRoadTripMoustache does not sell, exchange, or transmit your personal information to third parties except for these Partners (as defined below).

Main definitions

The expression “Confidential Information” means your name, first name, address, and email address or any other personal information concerning you and belonging to you, including, in particular, any information transmitted to make a payment on the application.

LogicielRoadTripMoustache will never ask you and does not recommend that you disclose information with a high risk of identity theft, such as your credit card, passport, or social security numbers, as part of the Services, which are therefore excluded from Confidential Information. If you do so despite LogicielRoadTripMoustache’s recommendations, you acknowledge that you are solely responsible for any resulting damage. Resulting in the complete discharge of LogicielRoadTripMoustache.

LogicielRoadTripMoustache considers that the processing of Confidential Information, due to its nature, is not likely to risk your rights and freedoms. If you disagree, please notify LogicielRoadTripMoustache without delay.

The term “Partner” refers to the IT technicians, programmers, integrators, designers, and other stakeholders with whom LogicielRoadTripMoustache does business and who are trusted partners.

Purposes and legal motivations

To this day, no confidential information is retrieved by LogicielsRoadTripMoustache.

Accessibility and consent

You may, at any time, request access to your Confidential Information. LogicielRoadTripMoustache will then make it accessible to you, as soon as possible, in a way that is readable for you.

You may, at any time, request that your Confidential Information be updated or completed, which LogicielRoadTripMoustache will do as soon as possible.

Despite their necessity, you may at any time withdraw or limit your consent to the processing, in whole or in part, of your Confidential Information by LogicielRoadTripMoustache by notifying the responsible person mentioned below. The latter may then inform you if this prevents or harms, in part or in whole, the Service. The withdrawal of your consent will only be valid from its receipt by LogicielRoadTripMoustache.

Transmission to Partners

You expressly consent and authorize LogicielRoadTripMoustache to communicate, in whole or in part, all Confidential Information to its Partners for the purposes of the Service and the accomplishment of the Purposes. LogicielRoadTripMoustache signs agreements with these Partners to ensure that they undertake to respect a minimum level of security or, where applicable, in accordance with the requirements of the General Data Protection Regulation of the European Union.

LogicielRoadTripMoustache undertakes to notify Partners as soon as possible of any withdrawal of consent, modification, deletion or limitation requested or made to your Confidential Information in accordance with this document.

Transfer requiring a minimum level of security

In addition, LogicielRoadTripMoustache undertakes not to disclose or transfer Confidential Information to a third party that is not a Partner or to a country that is not recognized as having a minimum level of security or, where applicable, compliant with the requirements of the General Data Protection Regulation (GDPR) of the European Union.

Despite this minimal level of security, you may inform LogicielRoadTripMoustache, at any time, of your desire that certain information not be disclosed or transferred, provided that this does not have the effect of preventing part or all of the Service.

LogicielRoadTripMoustache does not know whether the information or content hosted, in whole or in part, as part of the Hosting Services was created by you or not by a third party mandated by you. You acknowledge that you are responsible for ensuring that any subcontractor you mandate complies with the GDPR.

Confidentiality of Confidential Information

LogicielRoadTripMoustache acknowledges implementing all reasonably necessary means to not disclose or reveal the Confidential Information it holds (legal obligations excluded) to third parties who are not Partners.

LogicielRoadTripMoustache wishes to specify that all of its personnel who process or otherwise may have access to Confidential Information are adequately trained to ensure compliance and respect for the procedures and mechanisms set out in this policy.

Security and Storage of Confidential Information

LogicielRoadTripMoustache has adopted, implemented, and maintained physical and technological mechanisms and measures to protect Confidential Information, safeguard its confidentiality, and ensure the monitoring of Confidential Information received. The Confidential Information you provide is saved and stored on a server with controlled access and the data is also encrypted.

LogicielRoadTripMoustache has, in particular, implemented the following measures:

- Encryption of certain sensitive data, such as passwords;
- Server updated regularly;
- Implementation of an effective firewall combined with an automatic IP exclusion system in the event of a known hacking attempt;
- Control of access and use of the Services; For example: a user cannot corrupt the space reserved for another user;
- Critical access protected by SSH keys, which are more secure than passwords;
- Constant server monitoring;
- Regular antivirus;
- Password validation system. Only strong passwords, i.e. those composed of more than twelve (12) characters and a combination of uppercase, lowercase, numbers, and punctuation, are accepted by LogicielRoadTripMoustache.

Despite the measures that LogicielRoadTripMoustache has implemented and the regular tests of the effectiveness of these measures, it is impossible to guarantee that data transmitted over the Internet is done so securely. LogicielRoadTripMoustache does not guarantee or represent in any way that the Confidential Information you provide is transmitted securely or that it is completely protected against interception, loss, malicious use, or modification.

LogicielRoadTripMoustache undertakes to notify any breach of the protection of one of your Confidential Information that constitutes a risk to your rights and freedoms to the applicable supervisory authority within seventy-two (72) hours, as well as to you, if necessary within the meaning of the General Data Protection Regulation, as soon as possible. Any breach of the security of Confidential Information will also be recorded in a register designed for this purpose and describe the situation, the repercussions, and the measures taken by LogicielRoadTripMoustache.

LogicielRoadTripMoustache assumes no obligation or liability for any damage that may result from the unsecured transmission, interception, loss, misuse, or modification of the Confidential Information that you transmit to the extent that LogicielRoadTripMoustache has complied with its obligations under this Agreement and has taken all necessary corrective measures following a breach of the protection of your Confidential Information.

Non-assignment

Subject to legal obligations, LogicielRoadTripMoustache will not sell the right to a third party to use Confidential Information. LogicielRoadTripMoustache does not distribute, without prior consent, any Confidential Information to third parties who are not Partners who could be used to contact you outside the Service. You will only receive messages from LogicielRoadTripMoustache or its Partners.

Deletion or Request for Retention of Confidential Information

You may request that LogicielRoadTripMoustache completely delete your Confidential Information from its database or request confirmation of such deletion if the Service provides for such deletion in any of the following cases:

- at any time, following the end of the Service by termination or cancellation for any reason whatsoever and if they are no longer required for the purposes of the Purposes or for the retention period provided by LogicielRoadTripMoustache;
- at any time following your withdrawal of consent.

Before any deletion, you can require that LogicielRoadTripMoustache keep your Information confidential in order, in particular, to ensure the contestation, exercise, or defense of your rights in court.

Information Collected Automatically

LogicielRoadTripMoustache automatically collects general information about your use of the Service. This information may include the IP address of your computer, the IP address of your Internet service provider, the web browser used to access the Service, the date and time of access to the Service, the operations performed while using the Service, the parameters relating to the particular pages visited on the Service, the time spent on each page and the content downloaded from the Service, if any. The general information that is collected automatically is used to improve the Service, or for marketing purposes, to manage the Service and system administration, or for other administrative purposes. LogicielRoadTripMoustache may use the general information collected automatically to create summaries relating to the use of the Service and user habits, demographics and purchases.

LogicielRoadTripMoustache uses “cookies,” which are small data files sent to your browser and stored on your computer’s hard drive, to track your use of the Service and to ensure your security in terms of user authentication. Information from cookies is used to facilitate the use of the Service and to improve its user authentication function when you access the Service. Compliance

LogicielRoadTripMoustache acknowledges having made every effort to comply with any applicable regulation or law concerning the protection of confidential data, such as, in particular, the General Data Protection Regulation of the European Union. In the event of a contradiction between the terms hereof and those of any applicable law or regulation, the latter shall prevail.

Changes to the Privacy Policy

LogicielRoadTripMoustache reserves the right to modify this Privacy Policy at any time by posting a new Privacy Policy. LogicielRoadTripMoustache will then send you a notice to advise you that changes have been made. The collection, use, and disclosure of your Confidential Information by LogicielRoadTripMoustache will be subject to the version of the Privacy Policy that is then posted and in effect, unless you notify LogicielRoadTripMoustache that you do not consent to it, in whole or in part.
